1. Acceptance of these terms
By creating an account or using mygentree, you agree to these Terms of Service and the Privacy Policy. As the banner above states, both are drafts pending review by a qualified attorney — not yet finalized, legally reviewed documents.
2. What mygentree is
mygentree is a free family-tree application that lets family members build a shared tree, view relatives within privacy-controlled boundaries, and manage what information about themselves is visible to whom.
3. Accounts and eligibility
You sign in with a Google account. You're responsible for the accuracy of the information you submit and for keeping your account secure. Joining an existing family tree requires a six-character family code and approval from that family's owner.
4. Your content
You retain ownership of the information you submit (your profile, photos, and the relationships you describe). By submitting it, you grant mygentree the right to store and display it to the family members your privacy settings and the app's visibility rules permit — see the Privacy Policy for how those rules work.
Because a family tree describes real people, some of whom may not be the ones entering their own information, please enter information about relatives in good faith and remove or correct it if asked to by the person it describes (or, for a minor, by their parent or guardian).
5. Acceptable use
You agree not to:
- Use a family code to access a tree you don't have a genuine family connection to.
- Submit information about another person that you know to be false or that violates their privacy in a way they haven't consented to.
- Use the app to harass, harm, or violate the rights of others.
6. Optional information
Except for your name, all profile information you provide — including but not limited to address, phone number, email, birth date, education, profession, and photos — is entirely optional and provided at your own discretion. You are responsible for deciding what information you are comfortable sharing, and may use the app's privacy controls to limit its visibility to other family members.
This disclaimer helps set clear expectations, but it is not a substitute for actual legal review, and does not by itself eliminate the app's responsibilities around data it stores — particularly data about minors, which a family tree inherently includes even when entered voluntarily by another family member on the child's behalf. Whether and how this kind of optional/discretionary language actually limits liability depends on jurisdiction and data type, and needs a real attorney's judgment, not just careful wording, before being relied upon.
7. Privacy
How we collect, use, and let you control your information is described in the Privacy Policy, which is part of these Terms by reference.
8. Intellectual property
The mygentree name, logo, and app design are owned by mygentree. You keep ownership of the content you submit (Section 4).
9. Disclaimers and limitation of liability
mygentree is provided “as is,” without warranties of any kind. To the fullest extent permitted by law, mygentree is not liable for indirect, incidental, or consequential damages arising from your use of the app, including damages related to information submitted by other family members about you. This section, like the rest of this document, is placeholder language pending legal review — the actual, enforceable scope of any limitation of liability is a legal determination, not something finalized by this draft.
10. Termination
You may stop using the app and request account deletion at any time (Privacy Policy, Section 9). We may suspend or terminate access for violations of these terms.
11. Governing law
The governing jurisdiction for these terms has not yet been determined and will be finalized as part of legal review.
12. Changes to these terms
Once finalized, we'll note the date of the last update at the top of this page and, for material changes, take reasonable steps to notify users.
